Terms of Service

These terms govern your use of AvenueX (“AvenueX”, “we”), a social e-commerce marketplace. By using our website or apps, you agree to these terms.

1. Who can use AvenueX

You must be at least 18 years old and able to form a binding contract. You are responsible for keeping your account credentials secure and for activity under your account.

2. Our role as a marketplace

AvenueX is a venue that connects independent buyers and sellers. Unless stated otherwise, we do not own, sell, or ship the products listed. Sellers are responsible for their listings, pricing, accuracy, fulfilment, and after-sales support. Any contract of sale is between the buyer and the seller.

3. Buying and selling

  • Listings must be accurate, lawful, and not misleading.
  • Buyers should review listings and confirm details with the seller before purchasing.
  • Delivery, returns, and warranty terms are set by each seller and shown on the listing or store.

4. Imported products

Items marked as imported ship from overseas suppliers. Delivery times are estimates and customs duties or taxes may apply. When you click through to an external retailer, that retailer's own terms and policies apply to your purchase.

5. Payments

Payments are processed by third-party providers (e.g. Paystack). By paying, you agree to the provider's terms. Some sellers may offer pay-on-delivery or other methods at their discretion.

6. Prohibited conduct

You agree not to use AvenueX to list illegal, counterfeit, unsafe, or restricted items; to defraud or harass others; to infringe intellectual property; or to circumvent our safety features. We may remove content or suspend accounts that violate these terms.

7. Content & intellectual property

You retain rights to content you post, and grant AvenueX a licence to host and display it to operate the service. The AvenueX name, logo, and platform are our property.

8. Disclaimers & liability

The service is provided “as is”. To the extent permitted by law, AvenueX is not liable for the acts of sellers or buyers, the quality or delivery of products, or indirect losses. Nothing in these terms limits liability that cannot be limited under applicable law.

9. Governing law

These terms are governed by the laws of the Republic of Kenya, and the courts of Kenya have jurisdiction, without prejudice to mandatory consumer-protection rights you may have.
